EXECUTIVE ORDER NO. 41

AN ORDER CREATING THE COMMITTEE ON DECUROM AND INVESTIGATION ON SEXUAL HARASSMENT CASES (CODI) OF THE LOCAL GOVERNMENT UNIT OF CALBAYOG CITY

WHERERAS, Section II of the 1987 Consitution provides that the State values the dignity of every human person and guarantess full respect for human rights;

WHEREAS, the Philippines Congress enacted on February 14, 1995, Republic Act No 7877 otherwise known as the “Anti-Sexual Harassment Act or 1995”, which took effect on March 15, 1995 and declares unlawful sexual harassment against womenand men in the employment. education and training environment,

WHEREAS, Section 4(a) of Republic Act No. 7877 mandates every employeer or head of agency in the public and private sectors to promulgate rules and regulations prescribing the procedure for the investigation of sexual harassment cases and the administrative sanctions thereof.

WHEREAS, Section 4 of Republic Act No. 6713, otherwise known as the “Code of Conduct and Ethical Standards for Public Officials and Employees, provides norms of personal conduct for public offials and employees to observe in the performance of official duties, and specifically directs that they shall act without discrimination against anyone, and shall at all times respect the rights of others and refrain from doing acts contrary to law, good morals, public policy, public order, public safety and public interest;

WHEREAS, The Civil Service Commission (CSC) issued Resolution No.01-0940, dated May 21, 2001, otherwise known as the Administrative Disciplinary Rules on Sexual Harassment Cases, defining the adm1n1strative invesigation, prosecution and resolution of sexual harassment cases in the public sector;

WHEREAS, Section 7 of CSC Resolution No. 01-0940 provides that a Committee on Decorum and Investigation (CODI) shall be created in all national or local agencies of the govenment state colleges and universities, including government-owned or controlled corporations with original charter, a CODI for this agency will be created.

WHEREAS, pursuant to the above guidelines, the City of Calbayog adopts and promulgates the folLowing rules concerning the proceeding of the Committee on Decorum and investigation.

NOW THEREFORE, by virtue of the powers vested upon me as the Local Chief Executive of the City of Calbayog, I hereby order the following:

Section 1. In a work-related environment, the Committee on Decorum and Investigation (CODI) shall be composed of the following:

Chairperson City Mayor
Members City Legal Officer
City Human Resource Management Officer
A representative from LGU- Calbayog City – recognized Employee Union
Secretariat 1.

Section 2. The Commitee shall have the following functions:

(a) Receive complaints of sexual harassment;

(b) Investigate sexual harassment complaints an accordance with the prescribed procedure;

(c) Submit a report of its findings with the corresponding recommendation to the disciplining authority for decision;

(d) Lead in the conduct of discussions about sexual harassment within the agency to increase understanding and prevent incidents of sexual harassment.

Section 3. The agency may formulate its own rules governing the term of office of its members which should not be more than two (2) years, and other matters pertaining to the functions of the Committee not otherwise provided in these Rules,

In Instances when a member of the Committee is the complainant or the person complained of in sexual harassment case, he/she shall be disqualified from being a member of the Committee in the processing of that particular complaint,

Section 4. There well be two (2) members of the Secretariat.

Section 5. There will be a Stipend/Honorarium for the members of CODI and Secretariat. Which will be given after the final decision is made. It will be per case and as follows:

Under this order, any allowable necessary expense incurred by the Committee, duly approved bY the Undersigned, shall be charged against GAD funds of this office, subject to the usual accounting and auditing rules and regulations.

Section 6. This order shall take effect immediately.
